Prepare Social Security numbers, addresses, and tax records only in the official filing system or on the official form. Keep every notice deadline separate from the Form 8379 request.
1. Confirm the route
- Joint federal income tax return filed or planned.
- Joint overpayment was or may be offset.
- Past-due debt belongs only to the other spouse.
- Requesting spouse is not legally obligated for that debt.
- Form 8857 ruled out when the dispute concerns joint tax liability rather than a refund allocation.
2. Identify the notice, agency, and year
- Tax year recorded.
- Offset notice kept.
- Agency receiving the offset identified.
- Underlying debt dispute directed to the agency on the notice.
- Separate IRS, appeal, collection, or court deadlines calendared.
3. Check the filing period and revisions
- General three-year-from-filing or two-year-from-payment period checked.
- Any section 6511 exception or extension reviewed when relevant.
- Different deadline wording in the current IRS web page, section 6511, and the November 2024 printed instructions identified before calculating a final date.
- November 2023 Form 8379 selected for 2023-or-later tax years until superseded.
- November 2024 instructions selected for 2024-or-later years until superseded.
- February 2026 post-release changes reviewed.
4. Gather the allocation records
- Joint return and affected schedules.
- Forms W-2 and W-2G for both spouses.
- Forms 1099 showing federal withholding.
- Estimated tax and other payment records.
- Refundable and nonrefundable credit worksheets.
- Community property state and applicable state rules identified.
5. Complete the form carefully
- Names and taxpayer identification numbers in the same order as the joint return.
- Injured spouse box marked for the correct person.
- Tax year entered.
- Part I eligibility questions completed.
- Part III columns reconcile: joint amount equals injured-spouse plus other-spouse amounts.
- Different mailing address entered only when needed.
6. Choose and verify the filing channel
- Original electronic return with Form 8379, if supported.
- Original paper return with Form 8379 in attachment-sequence order.
- Separate paper filing after the joint return, using the current IRS Service Center rule.
- Electronic Form 1040-X attachment route checked against the February 2026 IRS update and software support.
- No Taxpayer Assistance Center used as a substitute for a Service Center.
7. Attach and sign
- Required W-2, W-2G, and withholding 1099 copies attached when filing Form 8379 separately.
- Previously filed joint return not attached to a stand-alone request.
- Signature section completed for a stand-alone filing.
- Complete copy and submission proof retained.
8. Follow up
- IRS estimates treated as nonbinding: about 11 weeks with an electronic joint return, 14 weeks with a paper joint return, or 8 weeks when filed separately after processing.
- IRS correspondence answered by its stated deadline.
- Debt questions directed to the creditor agency, not to TOP as a debt adjudicator.
- Community property allocation reviewed before assuming a percentage.
