Before choosing the appeal route
- Keep the complete IRMAA determination notice and envelope.
- Record the notice date and the date it actually arrived.
- Identify the premium year, tax year, filing status, and income information Social Security used.
- Confirm whether the issue is a disagreement with the determination or new/corrected information that supports a new initial determination.
- Use the SSA-44 route for a qualifying life-changing event with lower income; do not treat SSA-44 as the general appeal form.
- If IRS data itself was wrong, obtain IRS correction evidence and follow the new-initial-determination instructions.
Deadline checklist
- Calculate 60 days from receipt of the notice, following the notice's instructions.
- Remember that Social Security usually presumes receipt five days after the notice date unless you show later delivery.
- Submit before the final day and keep proof.
- If late, include a detailed good-cause explanation and supporting evidence.
Request checklist
- Use Social Security's current online non-medical reconsideration service or the current Form SSA-561-U2.
- Verify that the paper PDF is the current edition; the official form reviewed on August 4, 2026 is marked 08-2025 and discontinues prior editions.
- Identify the issue as an IRMAA determination and state the premium year.
- Explain each reason for disagreement in clear, numbered points.
- State the correction requested without promising or assuming an outcome.
- Sign and date where required and use the filing channel identified by Social Security.
Evidence checklist
- Copy of the complete IRMAA notice.
- Relevant federal tax return and schedules for the year used.
- Documents supporting the correct filing status or other disputed fact.
- IRS correspondence when the IRS corrected information.
- A short index of attachments.
- Copies for personal records, with sensitive information protected.
Submission and tracking checklist
- Save the online confirmation number or submission screen.
- For paper or fax, keep a complete copy and delivery confirmation.
- Record the office, date, method, and any representative who assisted.
- Continue following Medicare premium billing instructions while the appeal is pending.
- Open every Social Security or HHS notice promptly.
- If the reconsideration is unfavorable, note the hearing deadline immediately.
Do not send personal identifiers to WhatDoIFile
The official request may require identifying information. Submit it only through a Social Security channel. WhatDoIFile does not collect Social Security numbers, Medicare numbers, tax returns, or appeal records.
