Do not assume benefits continue automatically. Ask the WIC agency to confirm whether the timely-hearing rule applies to the action in your notice.
When continuation generally applies
Federal rules say a participant who appeals termination within the 15-day advance adverse-action notice period must continue receiving WIC benefits until the hearing official decides the case or the certification period expires, whichever occurs first.
When it does not apply
- An applicant denied at initial certification
- A participant whose certification period has expired
- A participant who becomes categorically ineligible
- A request filed after the advance-notice period, unless the agency provides another protection
Continuation is not a new certification period
The rule does not extend WIC participation beyond the existing certification period. A separate recertification may still be required, and the agency may issue a new decision based on that process.
What to do now
- Read the notice for the action date, hearing deadline, and filing method.
- Request the hearing immediately if you disagree.
- Ask in writing whether benefits will continue and through what date.
- Keep appointment, benefit, and delivery records.
- Complete any required recertification steps while the appeal is pending.
