Medicaid fair hearing checklist

Prepare the request and hearing around the state notice, the disputed decision, and the exact result you are asking the hearing officer to order.

This is a preparation list, not a state filing form

Use the current notice for the correct office, deadline, and filing method. Do not send this checklist to CMS or enter case numbers on WhatDoIFile.

Before filing

  • Read every page of the decision or plan notice.
  • Mark the notice date, date of action, hearing deadline, and managed-care appeal deadline when applicable.
  • Identify the exact issue: eligibility, renewal, termination, reduction, delayed decision, or denied service.
  • Confirm whether a plan appeal must happen before the state fair hearing.
  • Ask whether an expedited process is available for an urgent health risk.

File and protect the record

  • Use an authorized mail, in-person, phone, fax, or online method listed by the state.
  • State which decision you dispute and the result you request.
  • Ask separately for continued benefits or services when appropriate.
  • Save a complete copy and proof showing the date submitted.
  • Record follow-up calls, names or office units, and reference numbers without publishing them online.

Request the case file

  • Ask for the eligibility or service record and all documents the agency or plan will use.
  • Check whether important evidence is missing, misread, outdated, or assigned to the wrong person or period.
  • Request accessible copies, interpretation, translation, large print, Braille, or another auxiliary aid when needed.

Build the hearing packet

  • The notice and any earlier related notices.
  • A one-page timeline with dates and submissions.
  • Copies of applications, renewals, uploaded records, postal receipts, and portal confirmations.
  • Income, household, residency, disability, or medical-service evidence directly related to the issue.
  • A short written explanation connecting each document to the disputed decision.
  • A list of witnesses and what each person can explain.

Prepare for the hearing format

  • Confirm date, time, time zone, telephone number, video link, or physical address.
  • Test the device, audio, connection, and document access for a remote hearing.
  • Provide the hearing office and other parties with exhibits as instructed.
  • Confirm the representative's authorization requirements.
  • Arrange a quiet location and enough time for the full hearing.

At and after the hearing

  • Explain the requested result first, then present the timeline and evidence.
  • Answer the hearing officer's questions directly and identify any factual disagreement.
  • Ask how the written decision will be delivered.
  • Read the decision promptly and follow any corrective-action or further-review instructions.
  • Keep the complete file after the case ends.
