USCIS receipt notices for properly filed I-90 renewals may extend the validity of the Green Card for 36 months from the expiration date printed on the card. The expired card and the receipt notice must be used together.
When the 36-month extension applies
The extension is for lawful permanent residents who properly file Form I-90 to renew an expiring or expired Green Card. Read the language on your own Form I-797 receipt notice. It states the extension and explains that the notice, presented with the expired card, is evidence of continued lawful permanent resident status.
When the receipt may not be enough
- The card was lost, stolen, destroyed, or never received, so you cannot present the physical expired card.
- The I-90 was filed for a reason other than a qualifying expiration renewal.
- The receipt notice does not contain the extension language.
- The person has conditional permanent residence and needs a different receipt notice connected to Form I-751 or I-829.
- The card and notice contain inconsistent identity information.
Employment verification
A Green Card is evidence of identity and employment authorization. USCIS states that the expired card together with the qualifying I-90 receipt notice can serve as evidence during the extension period. An employee chooses which acceptable Form I-9 document to present; an employer should follow the current I-9 rules and may not demand a specific document when other acceptable documentation is offered.
International travel
Do not assume that a case-status screen or payment receipt is a travel document. Before leaving the United States, check that you have the expired card and original extension notice and confirm current USCIS and carrier requirements. A person without usable proof may need temporary evidence before travel. Extended time abroad can create separate residence and admissibility issues that Form I-90 does not resolve.
How to request temporary evidence
If you need proof and lack a usable card-and-receipt combination, contact the USCIS Contact Center. USCIS may provide temporary evidence through an ADIT stamp placed in a passport or through a temporary Form I-94 with an ADIT stamp and photograph. The method and appointment requirement depend on the case.
Conditional cards are different
A two-year card does not become a 10-year card through I-90. A conditional resident generally files Form I-751 or I-829 to remove conditions. The receipt notice for that petition has its own extension language and period; use the instructions for that petition.
