How long do I have to appeal a Social Security overpayment?

Generally, submit reconsideration within 60 days after receiving the decision, but follow the exact instructions and dates printed on the notice.

SSA's current reconsideration page says to submit the request within 60 days after receiving the decision. The overpayment notice controls the individual deadline and filing instructions.

Do not confuse the 60-day appeal period with the first 30 days

SSA's current overpayment page says it waits at least 30 days after sending the notice before collection begins. If you request an appeal or waiver within 30 days, SSA says it will not collect until it decides the request. That collection protection does not replace the general 60-day reconsideration period.

What if the request may be late?

Submit it promptly anyway. Explain the delay in writing and ask SSA to determine whether good cause exists for extending the filing time. SSA policy allows that review, but an extension is not guaranteed.

How to protect the filing date

  • Record the notice date and the date it was actually received.
  • Use the online non-medical reconsideration service, upload Form SSA-561, or follow the local-office instructions.
  • Keep a confirmation, receipt, fax record, or mailing proof.
  • Do not wait for every supporting record before submitting the appeal request.
