SNAP fair hearing checklist

Prepare the request and record in the order most likely to protect deadlines and make the household’s disagreement easy to understand.

Start with the notice, not the evidence pile

First identify the action date, hearing deadline, continuation deadline, hearing office, and accepted filing methods. Then build the evidence around the issue being appealed.

Before requesting the hearing

  • Save every page of the denial, reduction, termination, or benefit notice.
  • Mark the notice date, effective date, hearing deadline, and certification end date.
  • Write the disputed issue in one sentence.
  • Identify the state or local hearing office and accepted request methods.
  • Decide whether to ask for continued benefits and note the repayment risk.

When filing

  • Make a clear oral or written request for a fair hearing.
  • Include the household name and case identifier only through the official state channel.
  • Identify the decision being appealed and its notice date.
  • Ask expressly for continuation when appropriate.
  • Request an interpreter, disability accommodation, accessible notice, or expedited handling when applicable.
  • Save the confirmation number, screenshot, fax report, office receipt, or postal proof.

Request from the agency

  • The state hearing procedures and scheduling information.
  • The relevant case file and free copies of materials needed for the hearing.
  • The eligibility or benefit calculation worksheet.
  • The policy, verification, or data match relied upon.
  • The name or contact method for rescheduling or reporting an attendance problem.

Build the hearing packet

  • Cover sheet with household name, hearing number, and contact information.
  • Short timeline of application, verification, notices, and reported changes.
  • Copy of the decision notice.
  • Documents supporting the disputed facts.
  • Your calculation or explanation of the correct benefit result.
  • Numbered exhibit list and copies for the method required by the state.
  • Witness list and brief note about what each witness knows.

Before the hearing date

  • Confirm whether the hearing is in person, by phone, or by video.
  • Test the phone, link, audio, charging, and private location.
  • Review the state’s evidence and write questions.
  • Send exhibits by the required deadline and method.
  • Confirm representative authorization, interpreter, and accommodations.
  • Request a postponement promptly if truly necessary; it can extend the decision timeline.

At the hearing

  • State the decision being appealed and the result requested.
  • Use the timeline and exhibit numbers.
  • Explain factual errors, calculation errors, missing verification, or misapplied rules.
  • Question the agency’s evidence and witnesses respectfully.
  • Ask how and when the written decision will be delivered.

After the hearing

  • Save the decision and envelope or electronic delivery date.
  • Check whether benefits were corrected within the required implementation period.
  • Read any overissuance, rehearing, state review, or judicial-review instructions.
  • Continue recertification and reporting duties while the dispute is pending.
