Start with reconsideration after an initial disability denial. SSA says to submit the request within 60 days after you receive the decision. Read the notice because it identifies the decision, appeal level, and filing instructions that apply.
Who should use this process
Use disability reconsideration when an SSA notice says you may appeal an initial medical disability determination at this level. A different issue—such as a non-medical decision, a decision that benefits should stop, or a reconsideration decision—may require another request or form. Follow the notice rather than choosing a form only by its title.
Deadline
SSA’s current reconsideration page says to submit a disability or non-medical request within 60 days after receiving the decision. SSA generally presumes receipt five days after the date on the notice unless you show that it arrived later. If the period may have expired, submit the appeal promptly, explain the delay in writing, and ask SSA whether it can extend the time for good cause.
Prepare the request
- Read every page of the SSA notice and confirm reconsideration is the stated next level.
- Gather the claimant and decision information requested by SSA without entering it on this website.
- List changes since the application, including new diagnoses, treatment, tests, medicines, providers, work activity, or contact information.
- Identify or submit relevant evidence. Do not delay the appeal request solely because every record is not yet available; tell SSA about additional evidence.
- Submit online when available, or follow SSA’s instructions for Form SSA-561-U2 and the disability appeal materials.
- Save the submission confirmation or a complete copy and proof of delivery.
Forms and filing channels
The online disability appeal collects the reconsideration request and updated disability information. For a paper or uploaded request, SSA identifies Form SSA-561-U2, Request for Reconsideration. Disability appeals may also require SSA-3441, Disability Report—Appeal, and authorization materials. Use SSA’s current page and your notice to select the correct documents; do not mail them to SSA headquarters.
After filing
A Disability Determination Services office in your state generally reviews the request and the original application. SSA sends a written reconsideration determination. You can check status through a personal my Social Security account. If you disagree with reconsideration, the notice explains how to request a hearing before an administrative law judge.
